The problem of civil society establishment at the postsoviet times is one of the most actual ones, and is paid much attention by literature in relation to the formation of legal state system of the CIS countries, taking into consideration the positive experience of constitutional and legal regulation of social relations.
The Ukrainian state and society are on the transformation stage of their development. The process of civil society formation has been started in Ukraine. This formation takes place within the general civilized rules and tendencies in Ukraine as well as in other states of the CIS, taking into consideration the religious peculiarities and history development.
The establishment and development of civil society in Ukraine are difficult and ambiguous.
We can distinguish some definite trends:
1. Main direction of civil society development takes its origins in the West-European civilization from the progressive evolution to the standards of European democracy.
2. Differentiation between private and public spheres of social life activities.
3. Establishing of the effective mechanism of civil right realization of participating in the voluntary unions.
4. The reformation of the Ukrainian civil society is influenced both by the Western and European development models, and by its own positive and negative experiences resulting from its traditions, culture, mentality, level of legal culture and citizens legal awareness.
5. The state increases the citizens control: an establishment of identification codes for taxpayers, usage of unpopular methods in view of terrorism and fight against drug dealing and so on)
6. The civil society makes a profound impact on the state by means of thrusting of the state institutionalization of new values and norms, the necessity of numerous prohibitions and limits introduction of ecological character)
7. The collaboration of the state and civil society.
Thus, we come to conclusion that the civil society of Ukraine develops actively, although there are some difficulties in the process of its establishment.
The reformation of the Ukrainian civil society allows the society to become more stable in its development, to create opportunities for a person’s development, defense of its rights and freedoms. Therefore, Ukraine must pass the long and hard way of the formation of its civil society and the respective democratic, legal, and social state.
